These Terms govern your use of the website operated by KGW TRANSPORTATION LLC ("the Company", "we", "us"), located at 7108 Gulfstream Pl, Dayton, OH 45424, United States. By using this site you agree to these Terms. If you do not agree, please do not use the site.

1. The site is descriptive

This website describes the Company's bare equipment rental scope across four bays: vessels and rail, heavy machinery, office machines, and the general yard. It is not a live inventory system, a rate sheet, a booking platform, or an equipment specification sheet. Bay and berth classifications describe categories of business activity — not current stock, pricing, or availability.

2. No rental is formed here

Filing a bay request or sending an inquiry through this site does not create a rental contract, a reservation, or a binding commitment on either side. Rentals are only formed under a written rental agreement executed by both parties, with condition inspection at out and return.

3. Bare-rental boundary

• No operator, no crew. All lines are classified as rental or leasing without operator or crew. We never supply operating personnel, skippers, or turnkey service through this site.
• Renter responsibility. Qualified, licensed operation, insurance and compliance with site and transport law rest with the renter under the rental agreement — not described or assumed here.
• Not safety advice. Nothing on this site is operation, rigging, or safety instruction. Manufacturer documentation and applicable law govern use of any equipment.
• Classifications only. R-numbers and bay groupings describe categories of activity, not certification status, model details, or condition of any specific unit.

4. Acceptable use

You agree not to:

• Use the site for unlawful purposes or to send false, misleading, or abusive communications
• Attempt to probe, scan, breach, or overload the site's infrastructure
• Scrape, harvest, or systematically download site content for commercial reuse without written permission
• Misrepresent your identity, company, or affiliation when submitting forms or email
• Use the contact channels to send unsolicited bulk messages or malware

5. Intellectual property

The site's text, design, graphics, crane-and-yard illustrations and underlying code are owned by or licensed to the Company and developed by KGW TRANSP. You may view and print pages for personal reference. No other use — copying, modifying, distributing, or creating derivative works — is permitted without prior written consent. "KGW TRANSPORTATION", the yard mark and the R-number system are identifiers of the Company.

6. Accuracy and errors

We aim for accuracy but make no warranty that site content is complete, current, or error-free. Typographical errors in classifications, descriptions or contact details may occur and may be corrected without notice. The binding description of any rental is the executed agreement.

7. Third-party links and services

The site links to third-party services (such as email clients). We do not control and are not responsible for third-party content, policies or practices. Inclusion of a link does not imply endorsement.

8. Disclaimer of warranties

THIS WEBSITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KGW TRANSPORTATION LLC AND ITS MEMBERS, MANAGERS AND DEVELOPERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THIS SITE. FOR DIRECT DAMAGES ARISING FROM SITE USE, OUR TOTAL LIABILITY WILL NOT EXCEED $100. THIS SECTION LIMITS LIABILITY FOR WEBSITE USE ONLY; IT DOES NOT LIMIT LIABILITY UNDER ANY EXECUTED RENTAL AGREEMENT, WHICH GOVERNS ITSELF.

10. Indemnification

You agree to indemnify and hold harmless the Company from claims, damages or expenses arising from your misuse of the site, violation of these Terms, or infringement of another's rights in connection with your use.

11. Force majeure

We are not responsible for delays or failures caused by events beyond reasonable control, including equipment supply disruptions, weather, utility outages, or third-party service failures.

12. Governing law and venue

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Any dispute relating to this site or these Terms shall be brought exclusively in the state or federal courts located in Montgomery County, Ohio, and you consent to their jurisdiction and venue.

13. Severability and waiver

If any provision is found unenforceable, the remainder continues in effect. Failure to enforce a provision is not a waiver of that or any other provision.

14. Entire agreement and changes

These Terms, together with the Privacy Policy, constitute the entire agreement regarding use of this site. We may update these Terms at any time by posting a revised version. Continued use after changes take effect constitutes acceptance.
